You forget that NGE is not only an anime franchise. There’s pachinko machines and coffee. Perhaps, though unlikely, GAINAX is attempting to inject some realism using one of their brands.
As for the second, I’m sure GAINAX can cover themselves with the excuse of parody, if such a measure exists in Japanese law, which it should considering the very large doujinshou market over there (though I guess it could also be that the massive concentration of otaku at Comiket repels the Japanese police).
